Terms of use · Version 2026-10-04-draft-2

Terms of use.

The rules for using this site, the client portal, and our texts and calls. Drivers and companies each have their own section.

Draft. Legal entity name and address are placeholders until set in the site configuration. This page must be reviewed by qualified US privacy counsel before launch.

These terms apply to mywork.co (the "Site"), the My Work client portal, and the text messages and calls My Work sends. The Site is run by [LEGAL ENTITY NAME], doing business as My Work ("My Work", "we", "us"). You accept these terms when you check the box agreeing to them on one of our forms, when you sign in to the client portal, or when you use the Site. If you do not agree, do not use the Site.

About the Site and who we are

[LEGAL ENTITY NAME], doing business as My Work runs a recruiting agency for trucking companies ("carriers"). Carriers hire My Work to find and screen CDL drivers and dispatch, safety and operations staff for their open positions, and carriers pay My Work for that work.

In these terms, "driver" means anyone who uses the Site or talks with us about a position, including dispatch, safety and operations candidates. "Company" means a business that asks us for staff or uses our services, and the people who act for it.

My Work refers candidates to carriers. My Work is not the employer of record for any position on the Site and does not make hiring decisions. Any employment, independent contractor or lease-purchase agreement for a position is between the driver and the carrier.

Who can use the Site

You must be at least 18 to use the Site. The Site is for people looking for work, or hiring, in the United States. If you use the Site for a company, you confirm that you may act for that company, and these terms bind the company too.

How we collect, use and share personal information is in the Privacy Policy. You can change cookie, text and email choices on Your privacy choices.

Drivers

  • Applying is free. My Work never charges drivers a fee.
  • When you apply, a My Work recruiter may call or email you about your application. Texts, automated calls and job-match emails each need your separate, optional consent, and you can stop each of them at any time.
  • Applying does not guarantee a job, an interview, a pay rate or a start date. A call from a recruiter is not a job offer.
  • The carrier decides whether to hire you. It sets its own requirements and runs its own checks, and any offer comes from the carrier.
  • Give true and complete answers, and tell your recruiter when something changes, such as your CDL, endorsements or availability. Carriers rely on what you tell us. If something you told us is wrong, a carrier may decide not to move forward.
  • We send your profile to a carrier only after you say yes to that carrier's position on a call with your recruiter, and we confirm each yes to you by text or email. Your profile holds your contact details, your answers on our forms and your recruiter's notes. It never includes your Social Security number, medical details or drug test results.
  • You can ask for a copy of your file at any time. You can withdraw from a position at any time by telling your recruiter.
  • My Work does not order background checks, motor vehicle records, PSP reports or Drug and Alcohol Clearinghouse queries. A carrier that runs them does so under its own disclosure and with your authorization. If My Work ever orders a report about you, we will give you a separate disclosure first.

How matching works

Software, which may include AI, helps our recruiters compare your answers with each carrier's requirements and decide whom to call first. It does not use race, color, religion, sex, national origin or disability. A recruiter reviews every match and makes every decision about presenting you to a carrier. The software never rejects anyone on its own. You can ask for a person to review your application, ask for an accommodation, or correct your information. See How we use automated tools.

Job information

Position details come from the carrier's own documents and are shown as of the date and version stated on the job page. Base rates are the carrier's stated rates. Weekly pay and other figures labelled "typical" are the carrier's examples at assumed miles or hours. They are not a promise of earnings by My Work or by the carrier. Positions can change or close without notice. If the Site and the carrier's written offer differ, the written offer controls.

Companies

Requests, prices and agreements

  • When you send a request, a My Work recruiting specialist may call or email you about it. After a request, we send you texts, automated calls or marketing email only if you checked the box for each one. If you leave the email box unchecked or unsubscribe, that address goes on no marketing list.
  • Sending a request on the Site does not create an agreement. My Work provides recruiting services only under an agreement signed by both sides.
  • Prices from the calculator and other prices on the Site are estimates for planning. They are not an offer, a quote or an invoice. Your signed agreement sets the fee, what triggers it, any discounts and add-ons, replacement terms and payment terms.
  • My Work does not promise a number of applicants, candidates, hires or seated drivers, a time to fill a position, or how long anyone stays, unless your signed agreement says so in writing.
  • Fees for candidates My Work introduces to you, including candidates you hire for a different position or at a later date, are set in your signed agreement.
  • Give us accurate position details and tell us when pay, requirements or other details change. We show those details to drivers as yours.
  • If these terms and your signed agreement differ, the signed agreement controls.

Your duties as the employer

You make every hiring decision, and you stay responsible for meeting the law as the employer or contracting party. That includes:

  • Background checks and driver records. If you order a background check, motor vehicle record, PSP report or Clearinghouse query, you give the disclosures, get the authorizations and send any adverse action notices that the Fair Credit Reporting Act, FMCSA rules and state law require.
  • Qualification and testing. You keep your own driver qualification files and run your own DOT drug and alcohol testing.
  • Equal opportunity. Your job requirements are job-related and lawful. You will not ask My Work to screen, rank, filter or refer candidates based on race, color, religion, sex, national origin, disability or any other characteristic protected by law. My Work may decline a job order or a requirement that it believes breaks these laws.
  • Fair-chance laws. You consider criminal history only when and how the law allows, including any individual assessment it requires. At My Work, criminal history comes up only when your DOT-related requirements call for it and only at a stage of hiring where the law allows the question. It always goes to a person for individual review, and no candidate is declined automatically because of it.

Candidate information

Candidate information My Work shares with you, in the client portal, by email or by phone, is confidential. You agree to:

  • use it only to evaluate that candidate for the position it was shared for;
  • share it only with people at your company who take part in that hiring decision;
  • never sell it, or pass it to other carriers, brokers, recruiters or lead lists;
  • keep it secure, and tell us promptly if it is lost, stolen or seen by someone who should not see it; and
  • delete it or return it when the position closes or when we ask, unless the law requires you to keep it.

My Work never gives carriers a candidate's Social Security number, medical details or raw drug test results. To get a driver's previous DOT drug and alcohol test results, use the request process DOT rules set, with the driver's specific written consent.

Contacting candidates

You may contact a candidate about the position My Work shared them for. A candidate's consent to texts and calls from My Work covers My Work only. Before you send automated texts or place autodialed, prerecorded or AI-voice calls to a candidate, get the candidate's own consent. Follow do-not-call and anti-spam laws in every contact.

Client portal

  • The client portal is for companies with a signed agreement. My Work gives access to the people you name. Each person uses their own sign-in. Do not share sign-ins, and tell us right away if you think someone else has used one.
  • The first time you sign in, we ask you to accept the client portal terms. Those terms, your signed agreement and these terms all apply to the portal.
  • Candidate information in the portal is confidential, and the limits under Companies apply to it. You may record a candidate's details in your own hiring system for the decision on that position. Do not export, copy or forward portal data to other carriers, brokers or recruiters, and do not use bots, scrapers or other automated tools to collect it.
  • Do not try to see another company's data or any part of the portal you were not given access to.
  • Approvals, declines and other decisions you make in the portal are your decisions as the employer. A request you leave unanswered is never treated as a yes.
  • When you decline a candidate, you pick a reason. Pick a reason that is job-related. It must never refer to a protected characteristic.
  • Reports and figures in the portal are for your own internal use. Your signed agreement controls fees and billing.
  • Portal access ends when your agreement ends, unless the agreement says otherwise. We may suspend access to protect candidates, other clients or the portal.

Text message terms

My Work runs two text programs. Both are run by [LEGAL ENTITY NAME]. Driver texts come from [TEXT NUMBER], and employer texts come from [EMPLOYER TEXT NUMBER]. Texts in these programs come from My Work only. Carriers, partners and other companies never text you through them.

My Work driver texts

For drivers who check the optional text box on our application or on a My Work lead form on Facebook or Instagram, or who say yes when a recruiter asks on a recorded call. Texts cover your application, questions from your recruiter, interviews, orientation, start dates and CDL jobs that match your answers. Driver texts carry no promotions, such as lease-purchase offers, partner offers or referral bonuses. Texts about matching jobs never offer lease-purchase or owner-operator positions. A recruiter tells you about those on a regular call.

My Work employer texts

For company contacts who check the optional texts box on our staff request form or on a My Work lead form. Texts cover your staffing request, candidate updates, scheduling and My Work recruiting services, including occasional offers about those services.

Both programs

  • Texts are optional. Agreeing is not a condition of applying, of any job placement, of requesting staff or of buying anything.
  • After you sign up, we send one text that confirms it.
  • Some texts are sent with automated technology, and some may be written with AI.
  • Message frequency varies. Message and data rates may apply.
  • Reply STOP to stop all texts from My Work to your number, in both programs. STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, OPT OUT and OPTOUT work too. You can also tell us any other reasonable way, such as telling your recruiter, calling or emailing us, or using Your privacy choices. We send one text to confirm, and then no more texts.
  • Reply HELP or INFO for help, or contact us at [SUPPORT PHONE] or [SUPPORT EMAIL].
  • After you stop texts, reply START, UNSTOP or YES to get them again.
  • You confirm that you are the subscriber or regular user of the number you give us. If you change or give up that number, tell us so we stop texting it.
  • Texts reach only US mobile numbers on wireless carriers that support them. Wireless carriers are not liable for delayed or undelivered messages.
  • We do not sell, rent or share your mobile number or your text consent with any third party or affiliate for their marketing. See Text messages in the Privacy Policy.

Automated and AI-voice calls

  • My Work places automated calls only to people who checked the separate, optional box for them: the automated and AI-voice calls box on our driver application or driver lead form, or the calls box on our staff request form or employer lead form. We never rely on a spoken yes for these calls.
  • These calls may use automated dialing technology, prerecorded messages, or an artificial or AI-generated voice, and may leave a message on your voicemail. Driver calls cover your application and CDL jobs that match your answers, and never offer lease-purchase or owner-operator positions. Employer calls cover your request and My Work recruiting services.
  • Each call says at the start that it is automated, names [LEGAL ENTITY NAME], doing business as My Work, tells you how to stop these calls and gives [CALLBACK NUMBER] for reaching us. Voicemail messages do the same.
  • An AI agent never claims to be a person. If you ask, it tells you it is My Work's automated assistant.
  • You can ask for a person at any time. Say recruiter, or specialist if the call is about staff for your company, and the call is transferred. If no one is free, a person calls you back.
  • To stop these calls, say stop or press 9 during a call, call [TOLL-FREE OPT-OUT NUMBER] and press 9, or tell us any other reasonable way. Stopping automated calls does not stop a recruiter calling you about your application. Tell us if you want no calls at all.
  • On driver calls, AI agents ask only about your application, jobs, scheduling and start dates. They never ask about criminal history, your Social Security number, date of birth, license number, health or drug tests, and they do not decide whether you move forward. A recruiter makes those decisions.
  • Agreeing to these calls is optional. It is not a condition of applying, of any job placement, of requesting staff or of buying anything.

Call recording

My Work may record and transcribe recruiter calls and automated calls, including with AI, so we keep accurate notes. We tell you at the start of the call, and you can say no. On a recruiter call, recording and transcription then stay off. On an automated call, the call ends and a person calls you back. Our call vendors may not use recordings or transcripts to train their own AI models. How long we keep recordings is in the Privacy Policy.

Acceptable use

When you use the Site, the client portal, or our texts and calls, do not:

  • give false information, pretend to be someone else, or apply or request staff for someone without their permission;
  • collect data from the Site or the portal with bots, scrapers or other automated tools, or submit forms with them;
  • copy job listings or candidate information to publish, sell or build another database;
  • try to get into accounts, data or systems you may not use, or test the security of the Site without our written permission;
  • interfere with the Site, overload it or upload malicious code;
  • use the Site to send spam, or to harass, threaten or discriminate against anyone; or
  • break any law, including employment, privacy and telemarketing laws.

We may block or remove submissions that appear abusive, and we may suspend access that breaks these rules.

Our content and trademarks

The Site's text, design and software, and the My Work name and logo, belong to My Work or its licensors. Carrier names, logos and job documents belong to the carriers, and we show them to describe their positions. You may view, print and share pages for your own job search or your company's own hiring. Do not copy, sell or republish the Site's content without our written permission.

Feedback

If you send us ideas or suggestions about the Site or our services, we may use them without paying you or owing you anything. This does not cover your personal information, which the Privacy Policy governs.

The Site links to sites we do not run, such as carrier websites and social media. Their own terms and privacy policies apply there, and we are not responsible for their content. If you use a My Work lead form on Facebook or Instagram, Meta's own terms and policies also apply to how Meta handles that form.

Disclaimers

We work to keep the Site accurate and available. To the extent the law allows, the Site, the client portal and their content are provided "as is" and "as available", without warranties of any kind, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the Site will be free of errors or always available. Job details come from carriers, and calculator prices are estimates. Some states do not allow some of these disclaimers, so some may not apply to you.

Limitation of liability

To the extent the law allows:

  • My Work is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from the Site, the client portal, or any position, carrier, candidate or engagement found through them.
  • My Work's total liability for any claim about the Site is limited to [LIABILITY CAP AMOUNT].
  • For services under a signed agreement, that agreement sets any limit on liability.

Nothing in these terms limits liability that the law does not allow to be limited, or any right you have under a law that cannot be waived by contract.

Indemnity by companies

If you use the Site, the client portal or our services for a company, the company will defend My Work and pay the losses, damages and reasonable legal fees My Work incurs from claims by others that arise from:

  • the company's job orders, hiring decisions or treatment of candidates;
  • the company's breach of its duties as an employer, including under the Fair Credit Reporting Act, equal opportunity laws, fair-chance laws and DOT rules;
  • the company's use of candidate information outside these terms;
  • texts, calls or other contact the company makes to candidates; or
  • position details the company gave us that were wrong.

If your signed agreement has its own indemnity terms, those terms control.

Disputes

  • Tell us first. If you have a problem with My Work, write to us at [SUPPORT EMAIL] or [POSTAL ADDRESS]. Say what happened and what you want us to do. Before either of us files a claim, we both agree to try for 30 days to resolve it informally. This step does not apply to small claims cases, urgent requests to a court, or complaints to a government agency.
  • Courts, no arbitration. These terms do not require arbitration and do not waive your right to bring or join a class action. A dispute that is not resolved informally goes to court.
  • Governing law and courts. The laws of [STATE] and applicable federal law govern these terms, without regard to conflict-of-law rules. Claims go to the state or federal courts located in [STATE], unless the law of the state where you live lets you bring them there.
  • Companies with a signed agreement. The agreement's dispute terms control for anything the agreement covers.

General terms

  • These terms, the Privacy Policy and, for companies, the client portal terms and any signed agreement with My Work are the whole agreement about the Site and the client portal. If they conflict, the signed agreement controls, then the client portal terms for anything about the portal, then these terms.
  • If part of these terms cannot be enforced, the rest still applies.
  • If we do not enforce a term right away, we can still enforce it later.

Changes to these terms

When these terms change, the version at the top changes. We post material changes on the Site before they take effect. A change applies from the date it takes effect and does not apply to a dispute you told us about before that date. If you keep using the Site after a change, the new terms apply. Your text, call and email choices stay as you set them, and any new kind of contact needs your new consent.
